La Oficina de Derechos Humanos de la ONU sobre el proyecto de ley antiterrorista de Sri Lanka
La Oficina del Alto Comisionado de las Naciones Unidas para los Derechos Humanos está instando a las autoridades de Sri Lanka a revisar sustancialmente un proyecto de ley contra el terrorismo que actualmente se está debatiendo en el Parlamento y a garantizar que esto marque un punto de inflexión en su enfoque de la seguridad interna.
“Estamos preocupados por el proyecto de ley revisado contra el terrorismo que actualmente se está considerando en el Parlamento de Sri Lanka para reemplazar la draconiana Ley de Prevención del Terrorismo. La derogación de la Ley de Prevención del Terrorismo debería marcar un punto de inflexión para una reforma significativa del enfoque de Sri Lanka hacia su seguridad interna, pero esta ley propuesta en cambio corre el riesgo de perpetuar patrones de violaciones del pasado,” dijo la portavoz Ravina Shamdasani en la rueda de prensa quincenal en Ginebra el viernes.
El proyecto de ley propuesto es sustancialmente idéntico a borradores anteriores que fueron retirados después de críticas generalizadas. Define los actos de "terrorismo" de manera demasiado amplia, restringe el alcance de las garantías judiciales, especialmente en lo que respecta a impugnar la legalidad de las órdenes de detención, y limita la capacidad de la Comisión de Derechos Humanos para visitar lugares de detención, entre otras disposiciones problemáticas.
“Si se aprueba en su forma actual, el proyecto de ley otorgaría poderes excesivos al poder ejecutivo para restringir derechos, con salvaguardias limitadas o nulas contra el abuso de tales poderes. Debilitaría los fundamentos legales necesarios para que las fuerzas de seguridad arresten a personas sin órdenes. También seguiría permitiendo la detención preventiva prolongada,” señaló Shamdasani.
“Instamos a las autoridades a entablar un diálogo significativo con la sociedad civil y otros actores para revisar sustancialmente el proyecto de ley y ajustarlo plenamente a las obligaciones internacionales de derechos humanos de Sri Lanka,” dijo.
