Ouganda : Ravina Shamdasani, porte-parole des Nations unies pour les droits de l'homme, exhorte le président à rejeter le projet de loi autorisant le procès de civils par des tribunaux militaires
La porte-parole du Bureau des droits de l'homme de l'ONU, Ravina Shamdasani, a exhorté aujourd'hui le président ougandais Yoweri Museveni à rejeter un projet de loi récemment approuvé par le parlement permettant les procès de civils devant des tribunaux militaires.
Le projet de loi d'amendement des Forces de défense du peuple ougandais 2025, qui a été adopté le 20 mai et qui attend maintenant la signature présidentielle pour devenir loi, élargit entre autres la compétence des tribunaux militaires, les autorisant à juger un large éventail d'infractions contre des civils.
“Nous exhortons le Président de l'Ouganda à rejeter le projet de loi régressif adopté au parlement qui permet les procès de civils devant des tribunaux militaires, pour un large éventail d'infractions.
Le jugement de civils par des tribunaux militaires est en principe incompatible avec le droit international des droits de l'homme. Cela soulève de sérieux problèmes en ce qui concerne l'administration équitable, impartiale et indépendante de la justice. De tels procès ne sont permis que dans des cas exceptionnels et sous réserve de conditions strictes.
L'approbation par le parlement des propositions régressives intervient à l'approche des élections au début de l'année prochaine, et parallèlement à une inquiétante augmentation des arrestations et des enlèvements, du harcèlement et de l'intimidation, ainsi que de la torture et d'autres mauvais traitements infligés aux membres de l'opposition politique,” a-t-elle déclaré.
