Seif Magango, porte-parole de l'ONU pour les droits de l'homme, parle d'un rapport de l'ONU appelant à rendre des comptes pour les violations commises à Tarhuna, en Libye
Le porte-parole des droits de l'homme de l'ONU, Seif Magango, a fait les commentaires suivants lors du briefing bi-hebdomadaire à Genève : “Un nouveau rapport que nous publions conjointement avec la Mission d'appui des Nations Unies en Libye (MANUL) avertit que l'absence continue de responsabilité et les années d'impunité dont jouissent ceux qui sont derrière les violations et abus des droits de l'homme commis dans la ville libyenne de Tarhuna entre 2013 et 2022 risquent d'alimenter davantage d'instabilité et de division dans le pays.”
“Le rapport détaille comment les Al-Kaniyat, un élément armé apparu en 2011 et exerçant un contrôle brutal sur Tarhuna, une ville d'environ 150 000 habitants à 90 km au sud-est de Tripoli, ont commis de graves violations et abus des droits de l'homme, y compris des meurtres, des disparitions, des violences sexuelles, des enlèvements, des tortures, des mauvais traitements et des déplacements forcés entre 2013 et 2022,” a déclaré Magango.
“Il dénonce l'échec à rendre justice, ce qui a dans certains cas conduit à une violence renouvelée et à des violations répétées, fomentant davantage de griefs à Tarhuna et dans les zones environnantes. L'intégration des Al-Kaniyat dans l'ancien Gouvernement d'accord national (GAN) et plus tard dans l'Armée nationale libyenne (ANL), selon le rapport, a été un obstacle significatif à la responsabilité et à la justice,” a-t-il déclaré.
“Commentant le rapport, le Haut-Commissaire Volker Türk a déclaré : ‘Des années se sont écoulées depuis que ces terribles violations ont été commises, mais les auteurs n'ont toujours pas été traduits en justice, ni la vérité, la justice ou les réparations n'ont été apportées aux victimes et à leurs familles. L'impunité doit cesser – il doit y avoir une responsabilité conformément aux normes internationales de procédure régulière et de procès équitable,’” a déclaré Magango.
Le rapport – qui complète et s'appuie sur les conclusions de 2022 de la Mission d'enquête indépendante sur la Libye – recommande un processus complet de justice transitionnelle et de réconciliation, avec des mesures de recherche de vérité significatives et des réparations efficaces pour les victimes, y compris une aide juridique, un soutien en santé mentale et des garanties de non-répétition, conçues en consultation avec les personnes directement concernées. Il appelle également à des mesures de responsabilité robustes, par le biais d'enquêtes et de poursuites des auteurs présumés conformément aux normes internationales.
“Le rapport de la Mission d'enquête de 2022 détaillait des preuves d'atrocités commises à Tarhuna, y compris la découverte de fosses communes contenant des centaines de restes humains, la plupart menottés, les yeux bandés et portant des signes de torture, et avertissait de la possibilité qu'il pourrait y avoir jusqu'à 100 autres sites d'inhumation de masse,” a déclaré Magango.
