مكتب الأمم المتحدة لحقوق الإنسان حول مشروع قانون مكافحة الإرهاب في سريلانكا
تطالب مكتب حقوق الإنسان التابع للأمم المتحدة السلطات في سريلانكا بمراجعة جوهرية لمشروع قانون مكافحة الإرهاب الذي يثير قلقًا خطيرًا حاليًا يُناقش في البرلمان وضمان أن يكون هذا نقطة تحول في نهجهم تجاه الأمن الداخلي.
“نحن قلقون من مشروع قانون مكافحة الإرهاب المعدل الذي يُناقش حاليًا في البرلمان السريلانكي لاستبدال قانون مكافحة الإرهاب القمعي. يجب أن يكون إلغاء قانون مكافحة الإرهاب نقطة تحول لإصلاح جاد لنهج سريلانكا تجاه أمنها الداخلي، ولكن هذا القانون المقترح بدلاً من ذلك يخاطر بتواصل أنماط الانتهاكات من الماضي”، صرحت المتحدثة رافينا شامداساني في المؤتمر الصحفي الثنائي الأسبوعي في جنيف يوم الجمعة.
القانون المقترح متطابق تقريبًا مع مسودات سابقة تم سحبها بعد انتقادات واسعة النطاق. يحدد أعمال "الإرهاب" بشكل مفرط عريض، ويقيد نطاق الضمانات القضائية، خاصة فيما يتعلق بتحدي شرعية أوامر الاحتجاز، ويقتصر على قدرة اللجنة الوطنية لحقوق الإنسان على زيارة أماكن الاحتجاز، بالإضافة إلى أحكام أخرى مشكلة.
“إذا تمت الموافقة عليه بالشكل الحالي، فإن المشروع سيمنح سلطات مفرطة للسلطة التنفيذية لقيود الحقوق، مع قليل أو لا يوجد حماية ضد سوء استخدام تلك السلطات. سيضعف الأسس القانونية اللازمة للقوات الأمنية لاعتقال الأفراد دون أوامر قضائية. كما سيسمح لاحتجاز طويل قبل المحاكمة”، لفتت شامداساني الانتباه.
“نحث السلطات على التعامل بجدية مع المجتمع المدني وأصحاب المصلحة الآخرين لمراجعة مشروع القانون بشكل جوهري وجعله يتوافق تمامًا مع التزامات سريلانكا الدولية تجاه حقوق الإنسان”، قالت.
