كلمة رئيس بعثة تقصي الحقائق في ليبيا في المؤتمر الصحفي

السلام عليكم،

أولا، أود أن أرحب بكم جميعا اليوم في المؤتمر الصحفي لبعثة الأمم المتحدة لتقصي الحقائق في ليبيا لأعرض عليكم نتائج تقريرنا الثالث. اسمي محمد أوجار رئيس بعثة تقصي الحقائق في ليبيا، وأنا موجود هنا مع زملائي الخبراء في مجال حقوق الإنسان شيلوكا بياني وتريسي روبنسون. وسنطلعكم اليوم على التقرير الثالث لبعثتنا عن حالة حقوق الإنسان في ليبيا.

استهل كلمتي هذه بالقول أنه ما كان  لهذا التقرير أن يرى النور بدون جميع  من ساعدوا البعثة طوال الفترة المشمولة بالتقرير من آذار إلى حزيران. وأود ان اتقدم بالشكر لأولئك الذين قدموا لنا شهاداتهم الشخصية وإفاداتهم المكتوبة وغيرها من المعلومات – والتي كانت تعني في بعض الحالات إعادة إحياء الصدمة التي مروا بها او المخاطرة بسلامتهم الشخصية.

أنشئت البعثة عملاً بقرار مجلس حقوق الإنسان 43/39 ، وكُلفت بالقيام ، بطريقة مستقلة ونزيهة ، بتحديد وقائع وظروف حالة حقوق الإنسان في جميع أنحاء ليبيا ، لتوثيق الانتهاكات والتجاوزات المزعومة للقانون الدولي لحقوق الإنسان والقانون الدولي الإنساني من قبل جميع الأطراف في ليبيا منذ بداية عام 2016  ، والحفاظ على الأدلة بهدف ضمان محاسبة مرتكبي الانتهاكات والتجاوزات.

وقد أجرت البعثة أكثر من 300 مقابلة منذ أن بدأت عملها ونظمت اربع بعثات تحقيق إلى ليبيا. وتأسف البعثة لعدم تمكنها من السفر إلى سبها على الرغم من استعداداتها المكثفة. وقد كانت هذه الزيارة ضرورية للتحقيق بشكل دقيق في الادعاءات المتعلقة بالانتهاكات في الجنوب.

وفي الوقت الحاضر، لا تزال ثقافة الإفلات من العقاب قائمة وتشكل عقبة كبيرة أمام تحقيق المصالحة وجبر الضرر للضحايا وعائلاتهم. وقد واصلنا توجيه جهودنا لتقصي الحقائق في انتهاكات حقوق الإنسان والتجاوزات والجرائم الدولية التي تتحدى انتقال ليبيا إلى السلام والديمقراطية وسيادة القانون.

أما فيما يتعلق بالحرمان من الحرية ، فقد حددت البعثة أنماطًا واضحة لانتهاكات وتجاوزات حقوق الإنسان في 27 مكانًا من أماكن الاحتجاز الرسمية وغير الرسمية بما في ذلك السجون السرية وغير القانونية. وبناء على أكثر من 80 مقابلة مع محتجزين سابقين وحاليين وأقاربهم وشهود مطلعين، لدى البعثة أسباباً معقولة للاعتقاد بأنه تم ارتكاب جرائم ضد الإنسانية مثل القتل والتعذيب والسجن والاغتصاب والاختفاء القسري وغيرها من الأعمال اللاإنسانية في عدد من السجون.

كما تم إجراء تحقيقات مفصلة لبلدة ترهونة حيث تم توثيق ارتكاب ميليشيات الكاني على نطاق واسع ومنهجي لجرائم الإبادة والقتل والاختفاء القسري والتعذيب والسجن والتي ترقى إلى مصاف جرائم ضد الإنسانية.

كما نجحت البعثة في تحديد المقابر الجماعية غير المكتشفة سابقاً في ترهونة من خلال استخدام تكنولوجيا متقدمة. وستشارك بعثة تقصي الحقائق النتائج التي توصلت إليها مع السلطات الليبية للمساعدة في الوفاء بواجبها في التحقيق مع الجناة ومقاضاتهم ومعاقبتهم والمساهمة في وصول الضحايا الى حقهم في معرفة الحقيقة. وعلى الرغم من الجهود المستمرة التي تبذلها السلطات الليبية لاستخراج المقابر الجماعية في ترهونة ، تفيد التقارير أن أكثر من 200 شخص ما زالوا في عداد المفقودين ،الأمر الذي يتسبب في معاناة لا توصف لعائلاتهم ، الذين يحق لهم معرفة حقيقة  مصير أحبائهم.

وقد تم إعداد تقريراً مفصلاً حول ترهونة حيث ستقوم البعثة بمشاركة النتائج التي توصلت إليها على هامش جلسة الحوار التفاعلي لمجلس حقوق الانسان التي ستعقد في 6 تموز.

بالإضافة إلى ذلك ، تستمر حالات الاختفاء القسري بلا هوادة في ليبيا حيث تعرب البعثة عن قلقها البالغ إزاء استمرار اختفاء عضوة مجلس النواب سهام سرقيوة التي اختُطفت في عام 2019.

اما بالنسبة للتمييز والعنف فهما سمتان من سمات الحياة اليومية لمعظم النساء والفتيات في ليبيا. ويثير قلق البعثة بشكل خاص  فشل القانون المحلي في توفير الحماية من العنف الجنسي والعنف القائم على النوع الاجتماعي كما انه يساهم في إفلات مرتكبيها من العقاب. ومع ذلك ، تجدر الإشارة إلى بعض التطورات الإيجابية مثل إنشاء محكمتين مخصصتين لقضايا العنف ضد النساء والأطفال. هذا و يتعرض الأطفال لانتهاكات مماثلة لحقوق الإنسان مثل البالغين ، بما في ذلك الإعدام بإجراءات موجزة والاحتجاز التعسفي والعنف الجنسي والعنف القائم على النوع الاجتماعي والتعذيب.

من جهة أخرى فقد سلطنا الضوء على القيود والهجمات على منظمات المجتمع المدني ؛ وعلى النشطاء المدافعين عن حقوق الإنسان ؛ وعلى الصحفيين. إن المدافعين عن حقوق الإنسان ونشطاء المجتمع المدني هم العمود الفقري لأي مجتمع ديمقراطي. وهم حجر الزاوية للانتقال المستدام إلى الديمقراطية وسيادة القانون في ليبيا. لذا يجب أن يتوقف اضطهاد الناشطين على أساس التمييز بين الجنسين والتوجه الجنسي  والخلفيات الإقليمية والعرقية. هذا و ندعو السلطات الليبية إلى حماية هؤلاء النشطاء وضمان الحفاظ على الحريات في ليبيا. وقد واصلنا أيضًا توثيق أنماط متسقة من الانتهاكات الجسيمة لحقوق الإنسان ضد المهاجرين واللاجئين وطالبي اللجوء ، والتي لا تزال تحدث مع الإفلات التام من العقاب في مراكز احتجاز المهاجرين في ليبيا ، وفي مراكز الاتجار بالبشر ، وفي سياقات أخرى ترقى إلى جرائم ضد الإنسانية.

من جانبها توصي بعثة تقصي الحقائق ، كجزء من دعمها للسلطات الليبية لتعزيز دورها في حماية حقوق الإنسان، باعتماد خطة عمل وطنية شاملة لحقوق الإنسان حيث تهدف خطة العمل هذه إلى معالجة جميع النتائج والتوصيات الصادرة عن البعثة وغيرها من هيئات حقوق الإنسان ، وضمان الانتقال المستدام إلى السلام والديمقراطية والاحترام الكامل لحقوق الإنسان والالتزام بالمصالحة الشاملة.

الآن ، أكثر من أي وقت مضى ، يستحق الشعب الليبي التزامًا قويًا ، من الداخل وكذلك من المجتمع الدولي ، لتحقيق العدالة والسلام المستدام في بلده الأمر الذي لا يمكن تحقيقه دون إرادة سياسية قوية ودعم ثابت للانتقال الديمقراطي نحو دولة تقوم على سيادة القانون وحقوق الإنسان. كما ان إجراء الانتخابات الحرة والنزيهة ضرورة لتحقيق هذه الغاية.

ونرى أنفسنا كبعثة تقصي حقائق أننا جزءاً من الالتزام الدولي بتحقيق العدالة والمساءلة في ليبيا.

“Good morning. First, I would like to welcome you all today to the Independent Fact Finding- Mission on Libya’s third press conference to present to you the findings of our third report. My name is Mohamed Aujjar Chair of the FFM Libya and I am present here with my colleagues fellow human rights experts Cheloka Beyani and Tracy Robinson. The third report would not have come to fruition without all those who have engaged with the Mission during the most recent reporting period, from March until June. I wish to personally thank the victims who have shared with us their personal testimonies, written submissions and other information – which in some cases, meant reliving the trauma of their experiences, or risking their personal safety. Established pursuant to Human Rights Council resolution 43/39, the Mission was mandated to establish, in an independent and impartial manner, the facts and circumstances of the human rights situation throughout Libya, to document alleged violations and abuses of international human rights law and international humanitarian law by all parties in Libya since the beginning of 2016, including any gendered dimensions thereof, and to preserve evidence with a view to ensuring that perpetrators of violations and abuses are held accountable. The Mission conducted over 300 interviews since it started operating and organised four investigative missions to Libya. However, the Mission regrets not being able to travel to Sebha despite its extensive preparations. The visit would have allowed the exploration of crucial investigative opportunities to appropriately address allegations of violations in the south. At present, the culture of impunity continue to prevail, and poses a great obstacle towards achieving national reconciliation, and justice, truth and reparations for victims and their families. We continued to direct our fact-finding efforts towards human rights violations and abuses, and international  crimes, that pose a challenge to Libya’s transition to peace, democracy and the rule of law.  In terms of deprivation of liberty, the Mission identified clear patterns of human rights violations and abuses in 27 places of detention both official and unofficial including secret and extra- legal prisons. Based on more than 80 interviews with former and current detainees and their relatives and insider witnesses, the Mission has reasonable grounds to believe that crimes against humanity of murder, torture, imprisonment, rape, enforced disappearance and other inhumane acts have been committed in  a number of prisons. Detailed investigative work was conducted for Tarhuna documenting widespread and systematic perpetration of enforced disappearances, extermination, murder, torture and imprisonment amounting to crimes against humanity,  committed by Al Kani militias. The Mission also succeeded in identifying previously undiscovered mass graves in Tarhuna through the use of advanced technology. The FFM will share its findings with the Libyan authorities to assist in fulfilling their duty to investigate, prosecute and punish perpetrators and contribute to the right to the truth for victims. Despite the continuous efforts by the Libyan authorities to exhume the mass graves in Tarhuna, over 200 individuals are reportedly still missing, causing untold anguish to their families, who are entitled to know the truth about the fate of their loved ones.  A conference room paper on Tarhuna has been prepared and the Mission will share its findings during the Interactive Dialogue on 6 July. Additionally, enforced disappearances continue unabated in Libya. The Mission is greatly concerned regarding the continued disappearance of MP Sihem Sirgiwa who was abducted in 2019.  Discrimination and violence is a feature of daily life for most women and girls in Libya. Of particular concern to the Mission is that the failure of the domestic law to provide protection against sexual and gender-based violence is inherent to and contributes to impunity for such crimes.  However, some positive developments such as the establishment of two dedicated courts for cases of violence against women and children are to be noted. Children have been subjected to similar human rights violations as adults, including summary executions, arbitrary detention, sexual and gender based violence, and torture. We have highlighted restrictions and attacks on civil society organizations; on activists; on human rights defenders; and on journalists. Human rights defenders and civil society activists are the backbone of any democratic society. They are a cornerstone for a sustainable transition to democracy and rule of law in Libya. Persecution for of activists based on gender discrimination, sexual orientation, minority and regional background should stop.  We call on the Libyan authorities to protect those activists and to ensure that freedoms remain preserved in Libya.   We have also continued to document consistent patterns of gross human rights violations against migrants, refugees and asylum seekers, which still occur with total impunity in Libya’s migration detention centres, in trafficking hubs, and in other contexts, amounting to crimes against humanity.  Many of the violations documented by the Mission amount to international crimes, some of which are ongoing. A confidential list of individual suspects will be compiled by the Mission. This list will include the names of suspects, information about the potential suspect’s position or role, and a summary of evidence compiled by the Mission relating to the potential suspect. Libya remains without a permanent constitution and a legal framework capable of addressing the most serious human rights violations and international crimes, and its judiciary remains vulnerable to attacks and interference. We hail the effort of the judiciary in trying to function independently and impartially despite the threats and intimidation.  The FFM as part of its support to the Libyan authorities to strengthen their role in protecting and promoting human rights recommends the adoption of a holistic National Human Rights Plan of Action. The plan of action is to address all findings and recommendations from the Mission and other human rights bodies, ensure a sustainable transition to peace, democracy and full respect for human rights and commit to inclusive reconciliation.  Now, more than ever, the Libyan people deserve a strong commitment, from within and also from the international community, to bring justice, and a sustainable peace to their country. This cannot be achieved without strong political will and unwavering support for a democratic transition towards a  state based on the rule of law and human rights. Free and fair elections are essential to achieving this end. The FFM is part of the international commitment to achieving justice and accountability in Libya.  Thank you. Libya: new suspected mass graves uncovered in Tarhuna, says Human Rights Council probe

New suspected mass graves have been uncovered in Tarhuna, Libya, a Human Rights Council probe reported on Monday, highlighting continuing extreme rights abuses in the country that have affected children and adults alike.

Speaking in Geneva, Mohamed Auajjar, chair of the Independent Fact-Finding Mission on Libya, told journalists that a culture of impunity still prevailed across the war-torn country, representing “a great obstacle” to national reconciliation, truth and justice for the victims and their families.

Regarding Tarhuna specifically, the report gathered testimonies and found evidence of “widespread and systematic perpetration of enforced disappearances, extermination, murder, torture and imprisonment amounting to crimes against humanity,  committed by Al Kani (Kaniyat) militias”.

The Mission chair noted that its investigations had identified “previously undiscovered mass graves in the town”, which is around 65 kilometres from the capital, Tripoli, through the use of advanced technology. “We don’t know how many, now need to be excavated. But there have been hundreds of persons who have not yet been discovered, who have been disappeared.”

More than 200 individuals are still missing from Tarhuna and the surrounding area, causing “untold anguish to their families, who are entitled to know the truth about the fate of their loved ones”, Mr. Auajjar continued.

Women and girls have not been spared the fall-out of Libya’s destructive spiral since the overthrow of former President Muammar Gaddafi, in 2011.

Today, despite significant efforts to resolve longstanding differences, the internationally-recognized Government in Tripoli is still at odds with a rival administration and parliamentary authority in the east.

Among the report’s many disturbing findings is the fact that when women stepped forwards to present  themselves in yet-to-be-held national elections, they became the target of discrimination or violence.

Some have been abducted, part of pattern of enforced disappearances which “continue unabated in Libya”, Mr. Aujjar said, pointing to Member of Parliament Sihem Sirgiwa, who was taken in 2019. 

“Discrimination and violence is a feature of daily life for most women and girls in Libya,” Mr. Aujjar continued. “Of particular concern to the Mission is that the failure of the domestic law to provide protection against sexual and gender-based violence is inherent to and contributes to impunity for such crimes.”

Despite the welcome creation of two dedicated courts to rule on cases of violence against women and children, the rights expert warned that youngsters have faced “summary executions, arbitrary detention, sexual and gender-based violence, and torture”.

These include those accompanying adult migrants, refugees and asylumseekers who have been detained in Libya’s notorious detention facilities, according to the Fact-Finding Mission, which is to present its third report to the Human Rights Council on Wednesday 6 July.

First, I would like to welcome you all today to this press conference of the Independent Fact finding mission on Libya to present you the findings of our third reporter.

I would like to say that this report would not be doing without all those during the reporting period from March.

Based on more than former and currently their relatives and inside their witnesses, the mission has to believe that crimes against humanity were perpetrated, such as ******, torture and trade, enforced disappearance and other inhumane acts.
A number of detailed investigative work was conducted in Tatmana, documenting widespread and systematic perpetrations women as extermination, ******, torture and imprisonment amounting to crimes against humanity committed by.

The FFM, as part of its supporting authorities to strengthen the right, recommends the adoption of the Holistic National Human Rights Plan.
The Plan of Action is aimed at addressing all findings and recommendations from the Mission and other human rights bodies to ensure a sustainable transition to peace, democracy and full respect for human rights and to inclusive reconciliation.
Today, more than ever before, the Libyan people deserve a strong commitment from within and also from the international community to bring justice and the sustainable peace to their country.
This cannot be achieved without strong political will and unwavering support for democratic transition towards a state based on the rule of law and human rights.
Free and fair elections are essential to achieve this, and we are part of the international commitment to achieve justice and accountability in Libya.

So you've identified these three possible mass grave sites.
Presumably the next step is to investigate there.
And I see that you've urged the Libyan authorities to do that.
To what extent does proceeding depend on their willingness to do that?
Could you do that yourselves, for example, if the permission doesn't come through or the cooperation doesn't come through from them?
And secondly, there's a resolution to renew your mandate for nine months currently on the table.
How confident are you that this resolution in its current format will give you sufficient flexibility and sufficient time to pursue the important work ahead?

Zemo, you've noted that our mandate has officially ended and that there is a resolution relating to our extension, the kind of work which you are proposing.
I think the the question, the first question is can we go ahead and do the kind of investigations which are required if the state doesn't?
Generally the FFMS resources are fairly constrained.
We have had over the course of the last nine months of forensic Dr, which has facilitated in this year significant work which we were not able to do before.
But the kind of expansive investigations would probably have to involve the state.
And This is why we have in our report so clearly indicated that this is information that the state needs to act on.
It's the state's duty to act as well.
More investigations hopefully will continue in a renewed.
And your second question relates to whether the resolution in the current form will give us sufficient flexibility to work.
You know, we have learnt over the last two years that there are many challenges in conducting investigations, some of which are bureaucratic.
Even though we have access to Libya, as we've seen in the visit to Seba, there are challenges.
And so we would say that we would require the full commitment of the state to facilitate adequate investigations to complete the mandate in the required time.
We also have many, as you can see in the 2 reports, ongoing investigations which haven't been completed and places we haven't yet fully investigated and been to.
And that requires time and access, which have to be facilitated elsewhere.
So time is not content.
Time is not is not separated from some of the questions of access and bureaucracy, which are essential.
We don't control them on the FFM side, but we're certainly impacted by them.

You mentioned that you're preparing confidential list.
I think, Mr Muhammad, you mentioned the confidential list with the names of the perpetrators of violations, their positions and their roles.
Why will this list confidential and to what judicial party will it be addressed or how will the perpetrators be prosecuted and held accountable?
Libya is party to the Rome statutes.
Will you submit your findings to the ICC?
Especially as you mentioned that there is the possibility that war crimes and crimes against humanity may have been perpetrated.

I might have missed part of it trying to find the translation.
As you know, the International Criminal Court is already involved in carrying out investigations in Libya.
At this point in time, it has got its own jurisdiction and mandate under the Rome Statute.
It's investigating the most serious of crimes that have been committed or the evidence that will point out the Commission of such crimes.
Our mandate from the Human Rights Council is to preserve an evidence that we find and to hand it over to the Human Rights Council and it's other processes associated to the Office of the **** Commissioner for Human Rights.
Now whether eventually that will go to the ICC is not within our mandate, you know, to to decide.
It will be decided by the Human Rights Council and other bodies.

I don't think that the question on the the list was was fully answered.
If you could just say who that would be shared with and why it's confidential.
And on Sabha, could you explain why you weren't able to get access there?
Are you still pursuing access and what do you think you might find on the ground?

In terms of the the first part of your question linked to the to the colleague investigations are still going on at the moment.
And I think that the question of the preparation of the least will be at the tail end of the completion of the work of the FFM because of the fact that the evidence is leading to certain trials, obviously.
And if you read the report carefully, I think you will see that there are some sections where at least responsibility is indicated in terms of specific attacks.
For example, in the context of that of the violations of international humanitarian law, we indicate an attack on where we Emma Polyclinic.
Hit by rockets in April 2020 and this was under, you know, an attack under the control of particular groups which are indicated.
So where attacks have occurred, indications that also met of the areas under control in relation to the militias and what we need to follow up then is evidence of responsibility, individual criminal responsibility, whether through command structures or actual perpetrators.
And the next nine months will be quite critical to that.
And within the methods of investigations established by the field mission of the Office of the **** Commissioner for Human Rights, there is a database that is held in relation to such lists and the lists will therefore be preserved in that database for future use.
You also asked on, you know, the, the, the question of what was it?
I remember cyber, yes, the question of cyber, I think we have detailed in, in the report as well.
We had a fairly detailed arrangement to go to cyber logistics in place.
We had hired a plane, but at the last minute we're told that it was not actually appropriate or safe for us to go to Seba.
And such is the reality of the investigations.
So we hope that in the next nine months we'll be able to go to Seba as well.
As you recall, our mandate is to carry out investigations throughout the territory of Libya.
We have carried out investigations at least in the East, but we haven't been to the South.
And SEBA is quite critical in making sure that our report is is fair, it's impartial in terms of its findings.
And if we don't go to SEBA, the likelihood is that whatever final findings we make, including issues of attribution, will not be fair and will not represent the geographical scope in which those crimes have been committed.

Hi, Pascal, that's nice of you.
I had lowered my my hand in the interim.
But anyway, do do you so far have the number of suspected suspects that you have on your confidential list?
Are they in the in the, in the dozens or hundreds or I, I don't know.
And do do they, I know you can't give the names, but do they also include people from the current government, recognised international government, as well as others, rebel forces and so forth?

We cannot at this stage indicate any number of likely suspects that have come out of our investigations, largely because this is ongoing.
And if we indicated or released in any way, there are also serious consequences on the part of those that will be named, a fair trial, consequences, responsibility.
So it would only be fair, I think, for this to be done at the very end of the process of of our investigations.
But the magnitude is quite broad because so far we have carried out more than 3000 interviews in the process that we have been engaged in the context of the deprivation of liberty, for example, detention.
We've investigated 27 places, carried out more than 80 interviews.
So that that indicates at least you know, the, the, the scope of investigations, which is related likely, you know, to the magnitude of perpetration.
And what then remains to be seen by following the trail of the evidence will be the actual perpetrators themselves.
So numbers don't concern us very much.
It is the nature of the violations and those individuals that are likely to be involved in those violations.

Missionaries is a continuing thread of of our investigation and it is contained in our present report to the Human Rights Council.
I think broadly we note the deterioration or at least the numbers of missionaries are decreasing.
I think most of all because of partly the events and the conflicts in in Ukraine where a market may have been found elsewhere for missionaries.
So the the number of Syrian missionaries, the Wagner missionaries is also decreasing.
Nonetheless, we note that in the context of the African Union Convention on Missionaries, missionaries is a crime and therefore, notwithstanding the fact that the numbers are decreasing, we're still looking into the actual perpetration of certain atrocities, crimes and violations by missionaries.
In our report, we have focused so much on the planting of land mines and the effect of those land mines in relation to, you know, to the population and the fact that the role of land mines in this particular regard is is part of at the conduit of international crimes.
